1. Acceptance of Terms
By accessing or using PhotoRealify ("the Service"), operated by VECTORSPELL LTD ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
2. Description of Service
PhotoRealify is software that converts user-supplied images into higher-resolution, photorealistic versions using generative AI. Users upload an image and choose a realism level and output size; the Service re-renders the image and delivers the result.
3. Your Content and Rights Responsibilities
You must own, or hold all necessary licences and consents for, every image you upload. You are solely responsible for ensuring your uploads and your use of generated results comply with applicable law and third-party rights.
Generated results are upscaled versions of your own uploaded images. You are responsible for how you use, publish, and distribute them, including compliance with the rules of any platform where you publish them.
4. Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
5. Subscription and Billing
Credits System
Our Service operates on a credit-based usage system. The credit cost of a conversion depends on the realism level, the output size, and the resolution of the source image; the exact cost is shown before you start processing, and credits are only deducted when a conversion completes successfully. Each subscription tier includes a monthly credit allocation.
Billing
- Subscriptions are billed monthly in advance
- Prices are in USD unless shown otherwise at checkout; taxes may be calculated at checkout
- Subscriptions renew monthly until cancelled
- Included monthly credits reset each billing cycle and do not roll over
- Additional credits may be purchased as needed
Payment processing
Payments are processed through Stripe Managed Payments. For eligible Managed Payments transactions, customers may see Link as the merchant of record, and checkout, receipts, invoices, subscription management and transaction-level support may be provided by Stripe or Link. PhotoRealify is provided and operated by VECTORSPELL LTD, which remains responsible for the PhotoRealify software service, product access, image processing and product support. Your product access and use of the PhotoRealify service remain governed by these Terms and our Privacy Policy.
Cancellation and Refunds
You may cancel your subscription at any time. Upon cancellation, you retain access until the end of your current billing period. Refunds are handled as described in our Refund Policy.
6. Credits and Usage Units
Credits are SaaS usage units used only to access PhotoRealify processing features. Credits are not money, stored value, a wallet balance, electronic money, or transferable value. Credits cannot be withdrawn, transferred, resold, exchanged, or redeemed for cash or any financial asset.
7. Use of Outputs Outside the Service
PhotoRealify is a hosted processing platform. Any converted images you obtain from the Service and use, modify, or distribute outside PhotoRealify are entirely your own responsibility and risk.
8. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Upload images you do not have rights to, or upload a real person's likeness without their consent
- Share your account credentials with third parties
9. Intellectual Property
Your Content
You retain all rights to the images you upload and, to the extent set out in these Terms, the upscaled results generated from them. You may use your results for any lawful purpose, including commercial use, provided you had the necessary rights to the uploaded image. By using the Service, you grant us a limited license to process your images solely for the purpose of providing the Service.
Our Content
The Service, including its design, features, and underlying technology, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our proprietary content.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:
- That the Service will be uninterrupted or error-free
- That any particular upscaled result will meet your expectations
- That processing will complete within any particular time
- Any specific commercial outcomes from using the Service
IMPORTANT: AI-assisted image conversion is a fast-moving technology and output quality can vary between runs.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VECTORSPELL LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
12. Indemnification
You agree to indemnify and hold harmless PhotoRealify and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
14. Termination
We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
